By accessing or using the SoldAuto website as a dealership, you agree to comply with the following terms and conditions:
- No Direct Contact with Clients: As a dealership, you shall not directly contact or engage with the clients (sellers) who have submitted their vehicles for sale on the SoldAuto platform. All communication and negotiations must be conducted through the platform’s designated channels. Violation of this provision may result in account suspension or termination.
- Flat Fee for Direct Purchases: In the event that a dealership purchases a vehicle directly from a client within 90 days of the initial offer made through the SoldAuto platform, the dealership agrees to pay a flat fee of $650 to SoldAuto. This fee covers the services and benefits provided by SoldAuto throughout the selling process. Payment of the flat fee shall be made within 30 days from the date of the purchase.
- No Liability for Damages: SoldAuto strives to provide accurate condition reports and promote transparency regarding the vehicles listed on the platform. However, it is the responsibility of the dealership to conduct their own inspections and due diligence before making the final payment. SoldAuto shall not be held liable for any damages, discrepancies, or disputes arising from the condition or quality of the purchased vehicles. SoldAuto will provide a comprehensive condition report upon request to assist the dealership in their inspection process.
- User Account Responsibility: Dealerships are responsible for safeguarding their usernames and passwords associated with the SoldAuto platform. User accounts should not be shared or accessed by any unauthorized individuals. Dealerships shall immediately notify SoldAuto if they suspect any unauthorized access or breach of their account and take necessary steps to secure their account. Dealerships shall be solely responsible for any activities or actions conducted under their usernames.
- Offer Withdrawal: If a dealership makes an offer on a vehicle listed on the SoldAuto platform and subsequently decides to withdraw the offer, no fee will be charged to the dealership. However, the dealership shall provide written notification of the offer withdrawal to SoldAuto within 1 hour from the initial offer to ensure timely communication to the client.
- Termination Notice: SoldAuto may terminate the dealership’s account or access to the platform with no prior warnings. Termination may result from a material breach of these terms and conditions or for any other reasonable cause as determined by the terminating party. Upon termination, the dealership shall fulfill any outstanding obligations and cease using the SoldAuto platform
- Data Protection and Privacy: SoldAuto handles personal data collected from dealerships in accordance with its Privacy Policy. Dealerships acknowledge and agree to the collection, processing, and storage of their data for the purpose of facilitating the selling process and ensuring compliance with relevant data protection regulations.
- Platform Usage Restrictions: Dealerships shall not engage in any activities that may compromise the integrity, security, or functionality of the SoldAuto platform. This includes but is not limited to hacking, reverse engineering, unauthorized access, or any other actions that violate applicable laws or regulations. Dealerships shall comply with all applicable laws, including obtaining any necessary licenses or permits for their operations.
- Updates and Amendments: SoldAuto reserves the right to update or amend these terms and conditions at any time. Dealerships will be notified of any changes through email notifications, website announcements, or any other suitable method. Continued use of the platform after such changes constitute acceptance of the modified terms and conditions. Dealerships may provide feedback or suggestions regarding proposed changes to SoldAuto.
- Severability: If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law. The parties shall endeavor to replace any invalid or unenforceable provision with a valid and enforceable provision that achieves the intended purpose as closely as possible.
By continuing to use the SoldAuto website as a dealership, you acknowledge and agree to abide by these terms and conditions. SoldAuto reserves the right to modify or update these terms at any time without prior notice. It is recommended that you regularly review the terms and conditions for any changes.
